Sitting in the stands of a high school football game is NOT illegal in most states unless, of course, you have already been arrested for allegedly having sex with an underage boy and ordered to stay away from the lad.
Charlene Schmitz, 54, used to teach at Leroy High School in Alabama until she was charged with second-degree rape and second-degree sodomy with a 14-year-old boy back in June. Since then, Schmitz has been on paid administrative leave while the cops take their time investigating. The only stipulation of her bail was that she stay away from the alleged victim, which she did until last Friday night when she decided to sit next to the boy at football game. For violating the judges orders Schmitz was promptly re-arrested.

by having the sex with someone between the ages of 12-16. although the statute does say having "deviate sex" but i think that it probably means just about any sex... (AL Code Sec. 13a-6-64, FYI)

Sodomy is defined as any sexual activity that is not penile-vaginal intercourse.
So if there were oral sex involved, that would be sodomy.
The second degree was most likely because it was "consentual" even though he was underage. And chances are it had nothing to do with a strap-on or anything of the sort. Sodomy is "unusual sex", which includes acts such as oral sex.
I thought sodomy was either
a) sex with an animal or
b) in the butt.
Whatever.
and she isn't in jail? This is pretty damn sad.

When it is a man - he is a freaking sick perverted pedophile, who should have his thing cut off and be put to death.
When it is a woman it is underage sex.
